การซื้อขายฟอเร็กซ์ถูกกฎหมายใน ไทย หรือไม่
The rule
Retail forex/CFD trading itself is not criminalised for Thai residents - no law forbids trading via a foreign broker. However, anyone soliciting or operating securities/derivatives business to the Thai public must be SEC-licensed; unlicensed operation is an offence under the Securities and Exchange Act (1992) and Derivatives Act (2003). Spot FX transfers abroad are governed by BOT exchange-control rules. License check: SEC 'Check First' at https://market.sec.or.th/public/idisc/en/CheckFirst and Investor Alert at https://market.sec.or.th/public/idisc/en/InvestorAlert.
What the cap actually is
No Thai-issued retail forex/CFD leverage cap exists because SEC does not license such brokers domestically; Thais trade via offshore brokers whose leverage is set by their home regulator (ESMA/FCA/ASIC-style 1:30 majors, or unrestricted offshore 1:500+). Broker guides citing '50:1 majors / 20:1 exotics' are NOT an official BOT/SEC rule - unverified. As of 2025-2026 regulators were reportedly reviewing rules but no official blanket cap published. Verify: Not found on an official SEC/BOT page.
Measured across the base
How many of these firms are licensed here
Of the 100 brokers we measure for ไทย, 20 hold a local licence and the rest onboard residents through a foreign entity. That is not the same as being unregulated — it is a different question, and the broker pages name the entity in each case.
18 of them carry a warning from a regulator somewhere. A warning does not change a computed score here, but it removes the firm from beginner selections.
Warnings and where to read them
Yes. SEC Thailand maintains a public 'Investor Alert' list of unlicensed operators at https://market.sec.or.th/public/idisc/en/InvestorAlert (updated regularly). On 29 May 2025 SEC named five unlicensed crypto exchanges - Bybit, 1000X, CoinEx, OKX and XT.COM - and by 28 June 2025 the Ministry of Digital Economy issued blocking orders (these are digital-asset platforms, not pure forex). No official SEC page naming specific offshore forex-broker firms on a blacklist was found - Not found in research (forex-specific). Verify on the live Investor Alert list.
